All sex offenders are required to register in the State of South Dakota and to provide notice of each institution of higher education in South Dakota at which the person is employed, carries a vocation or is a student. Registered sex offenders can be identified by contacting the local law enforcement officials in our municipality. DEFINITIONS OF COVERED CRIMES Under the Clery Act, college employees are mandatory reporters for a broader array of serious crimes, including the following: CRIMINAL OFFENSES Murder and Non-Negligent Manslaughter: The willful (non- negligent) killing of one human being by another. Manslaughter by Negligence: The killing of another person through gross negligence. Sexual Assault (Sex Offenses): Any sexual act directed against another person, without consent of the victim, including instances where the victim is incapable of giving consent. A. Rape: The penetration, no matter how slight, of the vagina or anus, with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim. This offense includes the rape of both males and females. B. Fondling: The touching of the private body parts of another person for the purpose of sexual gratification, without the consent of the victim, including instances where the victim is incapable of giving consent because of his/her age or because of his/her temporary or permanent mental incapacity.
